Terms of Service

Welcome to GitVoyager! These Terms of Service ("Terms") govern your access to and use of GitVoyager's website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

GitVoyager is provided as a service ("we", "us", "our").

1. Acceptance of Terms

By creating an account or using GitVoyager, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

GitVoyager is a software-as-a-service (SaaS) platform that:

  • Connects to your GitHub account via secure OAuth authentication
  • Reads your public contribution data (commits, pull requests, issues, reviews)
  • Visualizes your coding journey as a space exploration adventure
  • Provides leaderboards to compare progress with other developers
  • Enables teams to track collective progress and compete together

The Service is provided "as is" and "as available". We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration and Security

3.1 Eligibility

You must be at least 13 years old to use GitVoyager. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

3.2 Account Creation

To use GitVoyager, you must authenticate via GitHub OAuth. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your GitHub account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.3 One Account Per Person

Each person may only maintain one GitVoyager account. Creating multiple accounts to circumvent restrictions, manipulate leaderboards, or for any other purpose is prohibited and may result in termination of all associated accounts.

4. Acceptable Use Policy

You agree to use GitVoyager only for lawful purposes and in accordance with these Terms. You agree NOT to:

4.1 Fair Play Violations

  • Create fake, automated, or artificial GitHub contributions to inflate your voyage distance
  • Use bots, scripts, or automated tools to manipulate your position
  • Create multiple accounts to appear on leaderboards multiple times
  • Exploit bugs or vulnerabilities for unfair advantage
  • Interfere with other users' enjoyment of the Service

4.2 Technical Violations

  • Attempt to access systems or data you're not authorized to access
  • Reverse engineer, decompile, or disassemble the Service
  • Overload or disrupt our infrastructure
  • Use automated scraping or data harvesting tools
  • Circumvent rate limits or access restrictions

4.3 Content Violations

  • Use offensive, abusive, or inappropriate usernames or profile content
  • Harass, threaten, or harm other users
  • Post spam or misleading content
  • Impersonate others or misrepresent your affiliation

We reserve the right to investigate violations and take appropriate action, including warning, suspension, account termination, and/or resetting voyage progress without refund.

5. Payment Terms

5.1 Free and Paid Plans

GitVoyager offers both free individual accounts and paid team subscriptions. Free accounts may have limited features compared to paid plans.

5.2 Team Pricing

Teams Plan: $5 per seat / month

Billed monthly. Minimum 2 seats.

  • Prices are in US Dollars (USD)
  • All prices are exclusive of applicable taxes (VAT, sales tax)
  • We may change pricing with 30 days' notice to existing subscribers

5.3 Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed securely via Stripe
  • You authorize us to charge your payment method on file
  • Failed payments may result in service suspension

5.4 Cancellation

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access to paid features until the period ends
  • No partial refunds for unused time in the current billing period

5.5 Refunds

Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, contact us within 14 days of the charge. We may offer refunds for:

  • Technical issues preventing service use
  • Accidental duplicate charges
  • Billing errors on our part

6. Intellectual Property

6.1 Our Intellectual Property

GitVoyager, including its design, graphics, code, features, and content (excluding user data), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Your Data

You retain all rights to your personal data. Your GitHub contribution data remains subject to GitHub's terms of service. By using GitVoyager, you grant us a limited license to:

  • Access and process your public GitHub data to provide the Service
  • Display your username and avatar on leaderboards and team features
  • Store your voyage progress and related data

This license terminates when you delete your account.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free license to use them without compensation or attribution.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results from the Service will be accurate or reliable
  • Any errors will be corrected

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GITVOYAGER, ITS OPERATOR, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from your use of the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.

7.3 Basis of the Bargain

You acknowledge that we have priced the Service and entered into this agreement in reliance upon these limitations of liability, and that these limitations are an essential basis of the bargain between us.

8. Indemnification

You agree to indemnify, defend, and hold harmless GitVoyager, its operator, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Service

9. Termination

9.1 Termination by You

You may terminate your account at any time by using the delete account feature in Settings.

9.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

  • Violation of these Terms or our Acceptable Use Policy
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended inactivity
  • Request from law enforcement or government agency

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Termination does not relieve you of obligations incurred before termination, including any payment obligations.

10. Dispute Resolution

10.1 Informal Resolution

Before filing any formal dispute, you agree to first attempt to resolve the matter informally through the appropriate channels. Most disputes can be resolved this way.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

10.3 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10.4 EU Consumer Rights

If you are a consumer in the European Union, nothing in these Terms affects your statutory rights under applicable consumer protection laws. You may also bring proceedings in the courts of your country of residence.

11. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will:

  • Post the updated Terms on this page with a new "Last updated" date
  • Notify you via email or in-app notification for significant changes
  • Give you reasonable notice before changes take effect (typically 30 days)

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GitVoyager regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it later.

12.4 Assignment

You may not assign or transfer these Terms or your rights without our prior written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, or infrastructure failures.
